Please read the
following terms and conditions carefully before ordering products or
services from us. By purchasing products or services from us, you
agree to these terms of sale. These terms do not replace or affect
your statutory rights. In these terms, "you" and "your" refer to the
customer and "we", "us" and "our" refer to CD FIXER / CDF ENTERPRISE
1.1 Only upon our receiving a completed order form by post
and upon our receiving cleared funds for the product(s) and or
service(s) ordered and an order receipt confirmation email is sent
to you, will a contract for the sale of product(s) OR service(S) you
order from us be created.
1.2 We will not be legally bound by any factual or
typographical errors on the website or other promotional materials.
We reserve the right to reject any order or payment for any reason.
1.3 We reserve the right not to accept any discs, payment
or order we receive.
1.4 We accept no responsibility, nor will we be held
liable for any disc(s) or other media which are lost, damaged or
delayed while in transit to us. We will only accept responsibility
for orders, discs or other media which have been received by us and
proven as received by Signature upon arrival.
1.5 We will have only entered into any contractual,
legislative or regulatory obligation once an order has been received
and accepted onto our premises and which we have deemed and
accepted, confirmed by an order received email, that an order has
been created which satisfies the terms laid out in Section 1.1 of
Liability and Disclaimer;
To the fullest extent permitted at law and except in respect of
death and personal injury caused by negligence on our part, or on
the part of our employees, we shall not be liable to you by reason
of any representation (unless fraudulent), or any implied warranty
condition or other term or any duty at common law or under express
terms of the contract for any indirect, special or consequential
loss or damage (whether for loss of profit or otherwise), costs,
expenses or other claims for compensation whatsoever (whether caused
by negligence on our part or the part of our employees or agents or
otherwise) which arise from, or in connection with the use of the
website, the supply of goods, incoming or return transit of goods,
the repair of goods or their use or resale by you, and our entire
liability under, or in connection with the contract shall not exceed
the price of the service or repair, except expressly provided in
these conditions. This does not affect your statutory rights.
3. Our Service Standards and Policy;
3.1 Standard Repair;
strive to repair to an operational condition, all discs supplied
under the REPAIR SERVICE by way of removing physical scratches from
the playing side(s) of optical disc(s). This service employs proven
methods and machinery that have a 97% success rate in the repair of
optical discs which are not operational due to the presence of
physical scratches on the playing side(s) of the disc(s) impeding
the laser's travel.
Unless otherwise stated, quoted or requested, all discs received are
processed under our Standard repair cycle which consists of no less
than a six minute repair on an industrial grade machine designed and
fit for the purpose of repairing optical discs. The success rate per
Standard repair will vary according to the severity of the damage to
the disc upon receipt.
Substantial damage to any discs will often require several repairs.
Such subsequent repairs incur further costs. If further repairs are
necessary, we contact you by email or phone, if supplied, and will
only carry out further repairs upon your approval.
The stability or integrity of the data and or data layer within any
disc upon receipt can not be guaranteed. Scratch and/or impact
damage to discs can corrupt or fatally damage a discs data,
regardless of repair method or standard subsequently used to repair
Discs are repaired to as close to 'as new' condition, without
scratches to the playable surface(s) of the disc, as possible. All
discs repaired are to be considered 'used' and the condition of such
after repair remains. Any wear or damage previously occurring to the
top, label sides, or hubs of discs will remain.
Some wear on the circular identifying label of any double sided DVD
discs may occur during the repair process. We reserve the right to
contact you by email, if supplied, upon receipt of any double sided
DVD discs which fall into this category. We accept no liability for
any damage or wear occurring to the identifying labels of any disc.
Some slight signs of wear may show on the centre hub of any disc we

We aim to repair discs on the day of their arrival, provided they
are supplied with a completed order form and payment and return
discs within two working days of their repair. Some delays are
possible; therefore this time frame may be extended and is not
guaranteed. We issue no guarantee to the timescale of orders.
We cannot be held responsible for any consequential damage or loss
caused as a result of repairs carried out, or attempted to be
carried out, or for a total loss of discs either while on our
premises or in transit to or from our premises.
3.2 Buff & Polish or Maintenance Service;
sent under the BUFF & POLISH service will only have the surfaces
refinished and no work will be carried out to remove any damage
below the uppermost surface of the polycarbonate layer. This service
is comparable to a 'Deep Clean' of the discs playing surface(s).
Therefore, discs with unreadable data due to the presence of
physical scratches impeding the laser's travel will not be repaired
using this process.
In the event of a disc being deemed to be beyond repair, PRIOR to
repair being carried out, we will issue a credit for the repair cost
paid for that disc or discs. Any discs we deem worthy of repair will
be passed through the repair process and are chargeable, only discs
we deem non repairable will not pass through the repair process and
a credit will be issued.
3.4 Inbound Postage
(from You to Us);
The responsibility for postage, insurance, packaging, tracking and
the carriage service used being suitable and safe lies with the
owner of the disc, or the customer, for any disc(s) while in transit
to, or sent to us.
We accept no responsibility, nor will we be held liable for any
disc(s) or other media which are lost, damaged or delayed while in
transit to us. We will only accept responsibility for orders, discs
or other media which have been received by us and proven as received
by Signature upon arrival.
We strongly recommend sending discs to us using Recorded Delivery,
for discs whose value is less than 46 pounds and using Royal Mail
Special Delivery for discs whose value is above 46 pounds, but less
than 500 pounds. It is not recommended to post discs to us using any
service that is not a tracked or a Signed For service at the very
NO CASES OR MANUALS ARE TO BE SENT WITH DISCS. CASES AND MANUALS
WILL NOT BE RETURNED TO THE CUSTOMER.
Any cases or manuals etc., received and expected to be returned to
the customer will incur a postage and administration charge payable
prior to despatch. Should the additional costs not be paid by the
customer in a timely manner, the disc only will be returned as
standard. Only once the costs are paid will the cases and/or manual
be returned to the customer.
